Pentagon papers case jury is sent home on Aug 9 until at least mid-Oct in what will apparently be longest pause in course of jury trial in US legal history; Fed Dist Judge Byrne declines to grant defense motion for mistrial even though defendants Ellsberg and Russo offer to waive their const protection against double jeopardy if Byrne would do so; Ellsberg and Ruso file paper agreeing not to object to subsequent trial if Byrne will dismiss jury that was sworn in 3 wks ago; defense attys L I Weinglass and L B Boudin argue that if jurors are returned to their usual pursuits for so long, they are likely to hear and read things that could affect their impartiality; Byrne calls 12 jurors and 6 alternates into ct and tells them they are free to travel until Sept 15, but after that they must inform jury clerk of any trip of more than 1 wk; says they should not discuss trial with anyone and that they should rept to him anyone who persists in talking about it
